Guarantee Committee

The d.p.r. 76/2010 (art. 4, c. 2) provides that ANVUR shall make publicly available the results of its analyses and evaluations, ensuring that the institutions concerned have the opportunity to request, on a reasoned basis, for one time and on the basis of procedures governed by the regulations referred to in Article 12, paragraph 4, letter a), the review of the evaluation reports approved by the Agency.

For that purpose, with art. 16 of the Regulation on the organization and operation of ANVUR (Adopted by Resolution of the Governing Board No. 25 of 10/08/2022 and entered 20/05/2022), a special Guarantee Committee has been established, composed of three components external to the Agency, adequately representative of the subjects assessed, according to procedures defined by the Board of Directors and in compliance with the Standards and Guidelines for Quality Assurance in the European Higher Education Area (ESG).

Composition

Pursuant to Directive Council Resolution no. 230 of 27/10/2021, the Guarantee Committee is composed as follows:

  • a member, with the function of President, designated by the Attorney General of the State;
  • for requests for review relating to University Institutions:
    • a teacher chosen by the Advisory Committee within a set of names indicated by the National University Council (CUN);
    • a student chosen by the Advisory Committee within a set of names indicated by the National Council of University Students (CNSU).
  • for requests for review concerning the Higher Education Institutions for Artistic, Musical and Dance Education (AFAM):
    • a teacher chosen by the Advisory Committee within a set of names indicated by the National Council for Higher Artistic and Musical Education (CNAM);
    • a student chosen by the Advisory Committee within a set of names indicated by the National Council for Higher Artistic and Musical Education (CNAM).

By Decree of the President of ANVUR n. 13/2022 the Agency adopted the designations received by the Attorney General of the State and the Advisory Committee of ANVUR (pending the appointment of the representative of the CNSU), following which the Guarantee Committee is now composed as follows::

Avv. Marco Stigliano Messuti President Designated by the Attorney General of the State
Prof. Antonio Marigonda Component Teacher designated by the CUN
Dr. Giulia Biundo Component Student designated by the CNSU
Dr. Francesco Fumelli Component Teacher designated by the CNAM
Miriam Passarelli Component Student designated by the CNAM

Jurisdiction

The Guarantee Committee shall decide on the requests for review made by Universities and AFAM Institutions as part of the initial and periodic accreditation procedures against the negative final evaluation measures, decided by the Governing Board of ANVUR (also taking into account any counter-deductions proposed by the institution involved) and transmitted to the Ministry of Universities and Research (MUR). In those circumstances, the Institution may request a review of the measure by lodging a reasoned request, for a single time and within 10 days of receipt of the negative final decision. The intervention of the Guarantee Committee shall concern only requests for review of:

  1. serious breaches in the procedure leading to the final assessment;
  2. obvious inconsistencies or inconsistencies in the formulation of the final judgment compared to the counter-claims made by the Institution if they substantially affect the outcome of the assessment;
  3. violations of the Agency’s code of ethics.

Procedures

Following the submission of the request for review, the Guarantee Committee carries out the necessary examination, following which it communicates to the Governing Board its reasoned decision on the admissibility or otherwise of the request. In case of eligibility, the Committee may propose:

  1. the revision of the decision of the Governing Board , taking into account any elements emerging from the analysis carried out by the Guarantee Committee itself;
  2. confirmation of the decision already taken.

Once the opinion of the Guarantee Committee has been obtained, the Governing Board shall communicate the outcome to the Institution concerned, within 45 days of receipt of the request for review.

For the initiation of the described procedure, in compliance with the above terms and conditions and using the appropriate editable form, the institutions concerned may send a reasoned request for review by PEC, to the following address: anvur@pec.anvur.it.
